The following is a list of growers whose fields passed field inspection in 2011 for the production of Foundation, Registered or Certified seed.
To be eligible for final certification, seed produced from these fields must be sampled, tested and inspected after cleaning or conditioning.
Field inspected seed is not certified seed until final certification has been approved and the seed has been properly labeled with the official certification tag, or a bulk certificate issued by the State Seed Department.
Certification of a variety should not be interpreted as a recommendation. Growers should check valid yield trial data nearest them. This is available in this Seed Guide and NDSU Extension and agricultural experiment station publications.
Certified seed transported in interstate commerce must comply with the rules and regulations under the Federal Seed Act and with the seed laws and regulations of the state into which it is transported.
Seed labeled with North Dakota Certified Seed bulk certificates or tags has been grown, conditioned, sampled and tested according to the rules and regulations outlined in the State Seed Department Bulletin No. 51.
Prospective buyers of seed from fields listed in the Seed Guide should contact the growers for price quotations and availability. Complaints in the cases of misrepresentation, mislabeling or violation of the regulations under which certified seed is produced and marketed should be made to the State Seed Department.
Prospective buyers should not construe varieties listed in this book as an offer for sale by the grower. This list shall not be considered as public advertising or as having posted public notice in any manner. Growers who wish to promote and sell seed must comply with all of the rules and regulations involved with the promotion and selling of seed in the state of North Dakota.
Classes of seed
Foundation seed (F) shall be so handled as to most nearly maintain specific genetic identity and purity. It shall be the source of Registered and/or Certified seed classes.
Registered seed (R) is one generation from Foundation seed and so handled that it meets the standards for Registered seed. Seed is eligible for one generation in this class.
Certified seed (C) shall be the progeny of Foundation, Registered or Certified seed that is so handled that it will meet certification standards. The Certified class is not eligible for re-certification unless in special cases, by authorization of the owner, or when Foundation seed is not maintained.
Limitation of warranty
A warranty of any kind, either expressed or implied, including a warranty of merchantability, fitness for a particular purpose, or absence of disease, is not made by the seed commission, the seed department, the seed commissioner or certified or noncertified seed producers as to the quantity or quality of the crop produced from the seeds or as to other produce which is inspected and certified, except as provided in this section. The sole warranty made is that the seeds were inspected and certified under the rules of the seed department or the United States department of agriculture. The seed commissioner functions and serves only in an official regulatory manner.
Field seeds certified in accordance with North Dakota seed certification regulations have been field inspected and laboratory tested as specified by rule. The state seed department and inspection services function and serve only in an official regulatory manner and do not relieve the grower or owner of the grower’s or owner’s responsibility.
Neither the producer, the seller, the North Dakota seed commission, the seed commissioner, or the commissioner’s employees make any warranty or representation of any kind, express or implied, as the quantity or quality of the crop produced from certified seed, including merchantability, fitness for a particular purpose, absence of disease, or varietal or selection identity. The only representation is that the seed was produced, graded, and inspected under the seed certification rules and regulations of the North Dakota State Seed Department.
